1. Agreement
These Terms of Service ("Terms") are an agreement between you and upstudio.ovh ("we", "us") covering your use of the YouPIP app for iPhone ("the App"). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the App.
2. What YouPIP does
YouPIP is a set of tools for developers. It includes:
- Browser: a web browser built on Apple's WebKit, with a start page, a favorites grid you can add to, edit, delete and reorder, access to local and LAN development servers, a User-Agent switcher, and options to share, copy and clear website data.
- Monitor: periodic HTTP checks of the websites and endpoints you add, showing the status code and response time. Checks run while the Monitor screen is open.
- API client: a tool for composing and sending HTTP requests and saving them to an on-device history.
- Dev Toolbox: offline JSON, JWT, Base64, URL, timestamp, UUID and hash utilities.
- Cloud Sync (optional): backup and restore of your monitor list.
You don't need an account to use the App. We may add, change or remove features over time.
3. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, as permitted by the App Store's Usage Rules. You may not copy, modify, sell, rent or distribute the App, or reverse engineer it except where the law expressly allows.
4. Acceptable use
You agree to use the App lawfully and responsibly. In particular, you must not:
- monitor, test or send requests to systems you don't own or aren't authorized to test;
- use the monitor or API client to overload, attack, scan for vulnerabilities in, or disrupt any server or network;
- use the browser or tools to access content illegally, get around access controls, or break the terms of the websites and services you use;
- use the App to infringe the intellectual property or privacy of others;
- interfere with the App, or with Cloud Sync or any other service it uses.
Requests sent by the monitor and API client come from your device and your network connection, and you are responsible for them.
5. Websites and third-party content
The browser displays websites that are owned and operated by third parties. We don't control, endorse or take responsibility for their content, availability or privacy practices, and your use of them is governed by their own terms.
The starter favorites (GitHub, Stack Overflow, MDN, DevDocs, Can I use, regex101 and Hacker News) are links to those public websites for your convenience, and searches typed in the address bar go to Google. Site icons are downloaded from the sites themselves. All third-party names, logos and trademarks belong to their owners. YouPIP is not affiliated with, sponsored by or endorsed by any of them.
6. Monitoring and tool results
- Checks run only while the Monitor screen is open. They depend on your device, network and iOS, and they may be delayed, paused or inaccurate.
- The App doesn't send push notifications or email alerts. Don't rely on it to detect outages of critical systems.
- Results from the API client and the Dev Toolbox (for example decoded JWTs, converted timestamps or hashes) are provided for reference. Check them before you rely on them. The JWT decoder doesn't verify signatures.
7. Cloud Sync
Cloud Sync is an optional, best-effort feature that stores your monitor list with Google Firebase, as described in our Privacy Policy. We don't guarantee that a backup will always be available. We may limit or discontinue Cloud Sync, and we'll try to give notice in the App first. Keep your own copy of anything important.
8. Your data and credentials
You own the data you enter in the App. Saved monitors, API requests and favorites are stored on your device. Saved API requests can contain tokens, passwords or other secrets, so you are responsible for protecting your device and for the credentials you choose to store. If you use Cloud Sync, you allow us to store and process your monitor list only to provide that feature.
9. Intellectual property
The App, including its design, code, name and logo, belongs to upstudio.ovh and is protected by intellectual property laws. These Terms don't give you any rights to our trademarks.
10. No warranty
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation, to the fullest extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, upstudio.ovh will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or business, including losses from outages that the App did not detect. Our total liability for any claim relating to the App is limited to the amount you paid for the App, if any.
Some jurisdictions don't allow these exclusions or limits, so they may not fully apply to you. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.
12. App Store terms
If you got the App from the Apple App Store, the following also applies:
- These Terms are between you and upstudio.ovh only, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App. For support, contact us at the address below.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation for the App.
- Apple is not responsible for any claims relating to the App, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, or claims that it infringes third-party intellectual property.
- You confirm that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Where these Terms don't cover something, Apple's Licensed Application End User License Agreement applies.
13. Changes and termination
We may update these Terms. If we do, we'll post the new version on this page and update the "Last updated" date. If you keep using the App after a change, you accept the updated Terms. You can stop using the App at any time by deleting it. We may suspend or end your right to use the App if you breach these Terms. Sections 5, 6 and 8 to 12 continue to apply after termination.
